These Terms of Service ("Terms") govern your use of Dishly, an online marketplace operated in British Columbia, Canada, that connects customers with independent restaurants, meal-prep services, and caterers ("Restaurant Partners") for online food ordering. By creating an account, placing an order, or registering a Restaurant Partner storefront, you agree to these Terms.
Dishly provides the online ordering platform, payment processing integration, and related tools. Dishly is not a restaurant, does not prepare or handle food, and does not provide delivery services. Each Restaurant Partner is an independent business solely responsible for their menu, pricing, food preparation, food safety compliance, order fulfillment, and — where offered — delivery arrangements.
You must provide accurate information when creating an account and are responsible for activity under your account and for keeping your password secure. You must be capable of forming a binding contract under the laws of British Columbia to place an order or register a Restaurant Partner account.
Prices, availability, and business hours are set by each Restaurant Partner and may change without notice. Payment may be made by card (processed securely through Stripe), cash, or e-transfer, depending on what a given Restaurant Partner accepts. Dishly does not store your full card details — card payments are handled entirely by our payment processor.
Orders are sent directly to the Restaurant Partner's kitchen upon submission. Dishly does not guarantee order acceptance, preparation time, or fulfillment — these are the responsibility of the Restaurant Partner. Cancellations, changes, and refunds are at each Restaurant Partner's discretion; contact the Restaurant Partner directly to resolve an order issue.
Where a Restaurant Partner offers delivery, it is arranged and performed entirely by that Restaurant Partner or a courier of their choosing — not by Dishly. Dishly is not responsible for delivery timing, handling, or any issue arising during delivery.
Some Restaurant Partners offer a loyalty points program. Points have no cash value, are not transferable, are specific to the Restaurant Partner that issued them, and may be modified, capped, or discontinued by that Restaurant Partner at any time.
If you register a Restaurant Partner storefront, you represent that you hold all licenses, permits, and food safety certifications required under British Columbia and applicable municipal law to prepare and sell food. Dishly charges a commission on completed orders as disclosed at the time you join and in your dashboard; commission on card orders is deducted automatically at the time of payment, and commission on cash and e-transfer orders is invoiced or charged to your card on file monthly, as selected in your settings.
Reviews must reflect a genuine completed order and may not contain false, abusive, or unlawful content. You agree not to misuse the platform, interfere with its operation, or attempt to circumvent its security.
To the fullest extent permitted under the laws of British Columbia, Dishly is provided "as is" without warranties of any kind. Dishly is not liable for the quality, safety, legality, or timeliness of any food or delivery provided by a Restaurant Partner. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under the Business Practices and Consumer Protection Act (British Columbia) or other applicable consumer protection legislation.
Dishly may suspend or terminate any account that violates these Terms or applicable law. You may stop using Dishly, or a Restaurant Partner may close their storefront, at any time.
These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You and Dishly agree to the exclusive jurisdiction of the courts of British Columbia, subject to any right you may have to bring a qualifying dispute before the British Columbia Civil Resolution Tribunal.
We may update these Terms from time to time. Continued use of Dishly after a change takes effect constitutes acceptance of the revised Terms.
